<summary type="text">The Impact of Online Hearings on the Enforcement of Arbitral Awards

Due to the flexible nature of arbitration, it was possible to continue arbitral proceedings through online hearings during the global COVID-19 pandemic. The immense use of online hearings during these tough times forced arbitral institutions to provide certain guidelines and principles regarding the organization of online hearings. Meanwhile, the arbitration community figured out the advantages and efficiency of online hearings. Along with the rapid increase in energy prices, inflation rates, and climate change concerns, we believe that online hearings will continue to be an indispensable part of international arbitration practice in the future. However, despite being cost and time-effective, online hearings raise discussions in the context of the right to a fair trial, the right to be heard, and the principle of equality of the parties provided by Article 6 of the European Convention on Human Rights and by Article 36 of the Turkish Constitution. In our study, we will examine whether online hearings per se will be considered as an infringement of the right to a fair trial in light of recent decisions of the Turkish Constitutional Court evaluating the use of online hearings in court practice. We will try to make conclusions whether and/or under which circumstances the use of online hearings will constitute a ground of setting aside under the Turkish International Arbitration Act or denial of recognition or enforcement according to the New York Convention.

This book considers the law relating to the legal aspects of unmanned ships. The author, a doyen of shipping and insurance law from Turkey, delves into the current international legal regime and examines the probable impact of unmanned ships on liability and carriage of goods in a wide-ranging manner. He examines both the legal aspects and technological peculiarities of unmanned ships, as well as contemplating terminological and linguistic questions, to find out whether they can be compatible with the current legal regime applicable to ships in general, while considering alternatives to enable their successful use in the near future. Unmanned Ships and the Law is therefore important not just for legal practitioners and academics in shipping and insurance but all those in related industries of shipbuilding, computer technology and communications.

<summary type="text">Control Centres in the Context of Unmanned Ship Operations – Their Status and Potential Liabilities*

This chapter concerns a novel, indeed rather revolutionary, conception, commonly called an “unmanned ship”. The control centre by definition is central to unmanned ship operations and needs to be regarded as the “foundation stone” of the whole scheme; so its definition is important. The Control Centres (CC) is likely to be the mainstay or “command post” of unmanned ship operations. The ship herself will be deserted, and fairly helpless if contact with the centre is interrupted or, worse, totally ceases. It follows that unmanned ships will have to be constantly monitored and kept under control and supervision by CCs. Unmanned ships involve high technology, of an extremely complex and complicated nature. Moreover, they are likely to be the product of several manufacturers, a substantial number of whom will not be of the category normally - and traditionally - involved with conventional ship construction, such as manufacturers of computer hardware, system analysts, software developers and so on. © 2024 selection and editorial matter, Baris Soyer; individual chapters, the contributors.

İnsan Üzerinde Deney ve Deneme Suçları başlıklı bu çalışmada öncelikle konuya ilişkin uluslararası ve ulusal düzenlemelere yer verilmiştir. Daha sonra 5237 sayılı TCK m. 90’da İnsan Üzerinde Deney Başlığı altında düzenlenmiş olan deney ve deneme suçları maddi ve manevi unsurlar ile hukuka aykırılık unsuru bakımından ele alınmıştır. Ayrıca bu suçların, suçun özel görünüş şekilleri bu bağlamda teşebbüs içtima ve iştirak bakımından taşıdığı özellikler incelenmiştir. Son olarak da deney ve deneme suçlarının soruşturma ve kovuşturma usulü ve bu suçlar için öngörülen yaptırımların taşıdığı özellikler açıklandıktan sonra sonuç kısmında deney ve deneme suçuna ilişkin kişisel kanaatlerimize yer verilmiştir.; This work titled Experimentations and Trial Crimes on Human Subject firstly evaluated international and national regulations on the subject. Then, the experimental and trial offenses regulated under article 90 of the Turkish Penal Code numbered 5237 titled Tests on the Humans were dealt with in terms of the material and moral/mental elements and the unlawful elements. In addition, the characteristics of these crimes, the special appearance of the crime, and attempt to crime, complicity, joinder of crime in this context were examined. Finally, after explaining the characteristics of the investigation and prosecution procedure of the experiment and trial offenses and the sanctions envisaged for these offenses, in the conclusion part, our opinion on the offense of experiment and trial was given.
