123K801 numaralı “Uluslararası Deni Hukukuna İlişkin Yargı Kararlarına Hâkim Temel İlkelerin Türk Deniz Hukukuna Etkisi” başlıklı TÜBİTAK projemizin Kapanış Çalıştayı, Proje kapsamında ulaşılan sayısal ve akademik analizleri paylaştığımız Çalıştay ve ileride yeni fikirlere ve tartışmalara vesile olması için öngörülen Panel oturumlarından oluşmuştur. Söz konusu Kapanış Çalıştayı, projenin temel amaçlarından biri olan geçmişten günümüze Türkiye’nin deniz hukuku sorunları ile Türk deniz hukuku politikaları kapsamında gerçekleşmiştir. Bu amaçla alanında uzman akademisyenler, uygulamacılar ve araştırmacılar davet edilerek konu hakkında kapsamlı tartışmalara yer verilmiştir. Elinizdeki çalışma, çalıştayda yer alan açılış konuşmaları, sunumlar, oturum başkanları ve panelistlerden birebir teyit alınarak oluşturulan konuşma metinlerinden oluşturulmaktadır. Bu şekilde çalıştaya katılamayan ancak konuyla hedef kitlede yer alan gruplara ve tartışmalara sonradan katkı sunmak isteyen herkese ulaşmak amacımız yerine getirilmiştir.  Proje sürecinde ve projenin tamamlanmasında emeği geçenlere edilen teşekkür aşağıdaki konuşma metinlerinde yer almaktadır. Ancak sabır ve sebat gerektiren uzun soluklu projeler ve çalışmalarda kıymeti daha iyi anlaşılan, iyi niyetli ve çalışkan yol arkadaşları ile iki yıllık kapsamlı bir projenin tamamlanmasının haklı gururunu yaşadığımızı ifade etmek gerekir. Bu süreçte projemize önemli katkılar sunan sevgili öğrencilerimiz Ezgi Nisa Kılıç ile Gizem Artar’a ve her etkinliğimizde bizlere destek olan Pîrî Reis Üniversitesi Deniz Hukuku Kulübü öğrencilerimize teşekkür ederiz. In this study, greenwashing acts are evaluated in terms of Turkish law, especially within the framework of the provisions of the Turkish Commercial Code on unfair competition and the regulations on consumer protection. In this context, direct and indirect legal regulations regarding green washing acts are presented. In addition, green washing acts are analyzed within the framework of the 1982 Constitution’s regulation on the right to environment and the Environmental Law No. 2872. The study also discusses the sanctions imposed by the Advertising Board on acts of green washing through advertisements. In addition, the extent to which the judicial decisions, particularly the decisions of the Court of Cassation, emphasize the acts of greenwashing is discussed. In particular, the scope in which these acts can be handled in terms of the offense of unfair competition and finally, whether the existing regulations are sufficient to prevent greenwashing acts are discussed and the need for national legal regulations within the scope of solution proposals is put forward by referring to the European Union directives on the subject.

<description>The Impact of Online Hearings on the Enforcement of Arbitral Awards

Due to the flexible nature of arbitration, it was possible to continue arbitral proceedings through online hearings during the global COVID-19 pandemic. The immense use of online hearings during these tough times forced arbitral institutions to provide certain guidelines and principles regarding the organization of online hearings. Meanwhile, the arbitration community figured out the advantages and efficiency of online hearings. Along with the rapid increase in energy prices, inflation rates, and climate change concerns, we believe that online hearings will continue to be an indispensable part of international arbitration practice in the future. However, despite being cost and time-effective, online hearings raise discussions in the context of the right to a fair trial, the right to be heard, and the principle of equality of the parties provided by Article 6 of the European Convention on Human Rights and by Article 36 of the Turkish Constitution. In our study, we will examine whether online hearings per se will be considered as an infringement of the right to a fair trial in light of recent decisions of the Turkish Constitutional Court evaluating the use of online hearings in court practice. We will try to make conclusions whether and/or under which circumstances the use of online hearings will constitute a ground of setting aside under the Turkish International Arbitration Act or denial of recognition or enforcement according to the New York Convention.

This book considers the law relating to the legal aspects of unmanned ships. The author, a doyen of shipping and insurance law from Turkey, delves into the current international legal regime and examines the probable impact of unmanned ships on liability and carriage of goods in a wide-ranging manner. He examines both the legal aspects and technological peculiarities of unmanned ships, as well as contemplating terminological and linguistic questions, to find out whether they can be compatible with the current legal regime applicable to ships in general, while considering alternatives to enable their successful use in the near future. Unmanned Ships and the Law is therefore important not just for legal practitioners and academics in shipping and insurance but all those in related industries of shipbuilding, computer technology and communications.
