<link>https://hdl.handle.net/20.500.12960/1796</link>
<description>Evaluation of Greenwashing Acts as Unfair Competition Offenses
Bayındır, Sinan
In this study, greenwashing acts are evaluated in terms of Turkish law, especially within the framework of the provisions of the Turkish Commercial Code on unfair competition and the regulations on consumer protection. In this context, direct and indirect legal regulations regarding green washing acts are presented. In addition, green washing acts are analyzed within the framework of the 1982 Constitution’s regulation on the right to environment and the Environmental Law No. 2872. The study also discusses the sanctions imposed by the Advertising Board on acts of green washing through advertisements. In addition, the extent to which the judicial decisions, particularly the decisions of the Court of Cassation, emphasize the acts of greenwashing is discussed. In particular, the scope in which these acts can be handled in terms of the offense of unfair competition and finally, whether the existing regulations are sufficient to prevent greenwashing acts are discussed and the need for national legal regulations within the scope of solution proposals is put forward by referring to the European Union directives on the subject.

<title>Economic policies and the European Social Charter</title>
<link>https://hdl.handle.net/20.500.12960/1528</link>
<description>Economic policies and the European Social Charter
Ataman, Berrin Ceylan; Atasayan, Gözde
This authoritative commentary drafted by scholars of the Academic Network on the European Social Charter and Social Rights (ANESC) is aimed at academic researchers studying social and economic rights in Europe and legal practitioners, civil society organisations, trade unions and state representatives engaging with the procedures of the European Committee of Social Rights. The text is composed of contributions from a large number of experts, bringing together senior and young scholars across different countries and legal traditions with expertise in social and economic rights and a commitment to enhancing the European system for regulating these rights.&#13;
&#13;
The commentary offers 106 chapters, organised into eight volumes, some of which are focused on the substantive obligations of State Parties to the European Social Charter and the practice of the European Committee of Social Rights and others on the procedures that state representatives, international bodies and applicants must follow to engage with the Charter system.&#13;
&#13;
Volume 1, entitled Cross-Cutting Themes, provides readers with descriptive and analytical accounts of the birth and evolution of the Charter system, the rules governing its interactions with domestic authorities, a number of thematic areas and concepts that elucidate the spirit of the treaty, and the differences and synergies between the European Social Charter and other European and international regulatory frameworks. This volume lays the groundwork for the article-by-article commentary on the European Social Charter that will be presented in the subsequent seven volumes, providing crucial context and highlighting the conceptual and operational links between the various Charter provisions. This first volume is edited by Stefano Angeleri (Queen’s University Belfast) and Carole Nivard (Université de Rouen).

<link>https://hdl.handle.net/20.500.12960/1445</link>
<description>Legal Assessment of the United Nations Convention on International Settlement Agreements Resulting from Mediation Regarding Civil Procedure and Enforcement-Bankruptcy Law
Yağcı, Mustafa Okan
The signing ceremony of the United Nations Convention on International Settlement Agreements Resulting from Mediation was held in Singapore on 07 August 2019. As per the Law No. 7282 regarding the Approval of the United Nations Convention on International Settlement Agreements Resulting from Mediation dated 25 February 2021, the Turkish Parliament deemed approval of the Convention suitable, and Presidential Decree No. 3866 dated 21 April 2021 approved the Convention.&#13;
&#13;
The Singapore Convention on Mediation, which [would] became part of Turkish legislation carries some questions in terms of domestic law. This study will assess the Convention in light of Turkish Civil Procedure and Enforcement- Bankruptcy Law. In this context, the study will first provide (1) some information with respect to regulations in the Convention such as (a) the scope of the Convention's application, (b) the enforcement of and reliance on settlement agreements, and (c) grounds for refusing to grant relief, and then discusses the issues of (2) whether or not the Convention applies to settlement agreements resulting from mediation conducted according to Turkish law and (3) how settlement agreements resulting from mediation conducted in a foreign contracting state should be evaluated under Turkish Civil Procedure and Enforcement-Bankruptcy Law regarding (a) the legal nature of settlement agreements and their consequences, (b) the ability to be subject to mediation, and (c) the effect of settlement agreements as a cause of action.
